Latest GRT report

I received the Gross Receipts Tax report from the Town Clerk late last week.  It appears that the anomaly from the previous report has not yet been reconciled and may have been repeated.  If the lower than expected amounts for September and October are, indeed, due to late filings by one or more of the town's major retailers then the numbers will eventually catch up and result in a larger than usual total.

Land Commissioner recount has been completed:

Various news sources, including the New Mexican and its sister publication Taos News, are reporting that the recount has confirmed Dunn's win with a margin of 658 votes.  The results are expected to be presented to the Canvassing Board on Thursday, December 18, 2014 for certification. 

P&Z packet for December 16, 2014

Draft budget for FY 2015

While searching for old P&Z minutes I stumbled across the draft budget for the current fiscal year in an addendum to the council packet file from July 16, 2014.  The budget information begins on p. 6 of the document.  Copies of many council packets are also available on Drive.  The draft minutes from July 16, 2014 as included in the council packet for the August 6, 2014 meeting state that there was no public comment offered and reflect no discussion, so it appears that the budget resolution was adopted as presented. 

Land Commissioner recount gets underway:

The Albuquerque Journal is reporting that some provisional ballots rejected on Election Day may be included in the recount if it can be determined that the voters had attempted but failed to register through MVD. However voters affected by MVD registration problems must be otherwise eligible to vote.

Ruidoso News is reporting that some County Clerks are having trouble obtaining the services of precinct workers because of the delays. 

The recounts are being conducted beginning this morning at the county level, and County Clerks will be provided with MVD information to help them verify which provisional ballots will be counted.  The recount started this morning.  Given the uncertainties surrounding verification of some 873 provisional ballots, the recount may take longer than expected.  The latest tally prior to the recount shows challenger Aubrey Dunn (R) with a 704 vote lead over incumbent Ray Powell (D).

Recount in Land Commissioner's race to begin tomorrow.

The Albuquerque Journal is reporting that the New Mexico Supreme Court has denied Ray Powell's petition, and lifted its stay earlier today.  State officials expect to begin recounting votes tomorrow.

Land Commissioner recount has been put on hold:

KRQE news is reporting that incumbent Ray Powell has asked the NM Supreme Court to intervene in the process, and his request was granted.  Arguments calling into question the accuracy of the state's vote counting machines will be heard on Wednesday.  The recount had been due to begin today.  Once the recount process begins, it is expected to take 2-3 days and will cost around $120,000. The state will foot the bill because the vote margin is such that an automatic recount is called for by state law.  The challenger, Aubrey Dunn, leads the tally reported by the NM Secretary of State by 704 votes.

The Town of Edgewood currently posts financial information such as bills paid and monthly Gross Receipts Tax revenues as part of the council packets on its Agendas and Minutes page. When available, I place copies on Drive in the Council Packet folder. Financial information is usually published just before the second regular town council meeting of each month and is found near the end of the document containing packet information. The budget adopted for FY 2014-2015 has not been posted at the Town website, but the FY 2013-2014 budget is available.

Recount to begin Dec. 8 in the Land Commissioner's race:

The Albuquerque Journal is reporting in a story published earlier today that the canvassing board will order a recount.  The Secretary of State's website was updated on 11/25/2014 at 10:31 AM.  The current vote totals are as follows:  Aubrey Dunn 250,185 and Ray Bennett Powell 249,481. Total votes cast:  499,666. 

No clear results in the Land Commissioner conest:

The difference in the vote tally between challenger Aubrey Dunn and incumbent Ray Powell decreases with each update from the Secretary of State's office. The latest totals published on 11/21/2014 show Dunn in the lead 250,251 to 249,507.  (total votes reported: 499,758)

[Edited on 09/19/2015  For those seeking more information on the development Santa Fe Ranch and Farms, which is part of a larger tract known as Campbell Ranch, please see this post: Campbell Ranch Update which was added on September 17, 2015. Most of the information about Campbell Ranch on the Portal concerns those tracts of land in Santa Fe, Bernalillo, and Sandoval Counties which were annexed by Edgewood on December 3, 2001. I believe Santa Fe Ranch and Farms is located in Santa Fe County just to the north of Edgewood's boundary.]

New numbers for the Commissioner of Public Lands race:

The unofficial tally from the Secretary of State was updated again on 11/17/2014 at 11:36 AM.  The page still shows a difference of less than .5% of total votes cast; however, the margin separating the two candidates has narrowed. By state law, the Canvassing Board must call for a recount at the state's expense if it concurs with the totals reported by the Secretary of State. Several news outlets are reporting that an official decision on the recount is expected on or soon after November 25, 2014.

The Town of Edgewood has advertised two public hearings which will take place during the regular Council meeting of Dec. 3, 2014.  The purpose for conducting the hearings is to amend the new Zoning and Subdivision Ordinances which were approved in August.

2014 Unofficial General Election Results for New Mexico:

Unofficial results for New Mexico are available at the website of the New Mexico Secretary of State.  The only race still in doubt is the contest for Commissioner of Public Lands.  The unofficial tally which was last updated on 11/05/2014 at 5:06 PM shows a difference of less than .5% of total votes cast. By state law, the Canvassing Board must call for a recount at the state's expense if it concurs with the totals reported by the Secretary of State.

I obtained a copy of ToE Ordinance 2014-05 (Planning Commission) from the Town Clerk which is archived on Drive.  I will post a link to the ToE website as soon as the ordinance is available there.  This ordinance amends and supersedes Ordinance 1999-S which I have moved into the folder containing outdated ordinances.  

Added 11/01/2014:  The new Planning Commission Ordinance is now posted at the ToE website in the Planning and Zoning section devoted to agendas and minutes.

Read the Ordinance: The Hill Family Trust minor subdivision

This application was brought forward for a public hearing scheduled for February 4, 2014 bearing Mayor Brad Hill's signature as trustee, Bradley Hill. However, because of a legal obstacle about which few details have been provided, the planning commission voted to table the application at the request of the applicant's agent. (Draft commission minutes for February 4, 2014 as found on p. 20 of the council packet for February 19, 2014)

It does not appear to have occurred to either the commission or the town staff that the new minor subdivision process approved eight months earlier made no allowance for tabling a matter; rather the ordinance specified that a final determination be made within sixty (60) days of receipt of the application.  (Subdivision Ordinance 2005-14 amended June 5, 2013; Section 6.C.2.)  In August 2014, that ordinance was repealed and replaced by Subdivision Ordinance 2014-03. If this or a similar application should be brought to the commission again, the newer ordinance would apply, but both versions of the ordinance direct the commission to make a final determination within 60 days.  

Upon reviewing the documents in the application which were obtained via an Inspection of Public Records Act request, I noticed several omissions in the staff report which led me to conclude that advertisement of the public hearing was premature, and to attempt to bring this information to the attention of the planning commission:

1.  The plat submitted with the application failed to specify the width of the road which was proposed for access to two of the proposed three lots. [It appears that it was questions about ownership of the road easement which resulted in the tabling of the application.]

2.  The staff report failed to note that this road lacked a culvert at the bottom of a draw, and that the turnaround located beyond the draw which would potentially be needed for emergency response vehicles lies on private land.

3.  The staff report failed to address the applicant's request for a waiver on soils analysis even though the town has on record information about septic tanks having failed on properties directly to the east and to the north of the proposed subdivision. [Planning Commission minutes for April 16, 2007.]

Despite my having followed the town policy as stated on the February 4, 2014 agenda regarding the submission of written comments, Town Administrator and Planning Director, Kay Davis McGill, instructed the planning commission to ignore these questions as well as documentation submitted regarding this application.

Read the Ordinance: July's R-2 zone district fumble

        When Councilor John Abrams expressed his opposition to the proposed elimination of the R-2 (Residential 2-acre) zone category in the new zoning ordinance during the July 2, 2014 council meeting, the situation devolved into the squabbling which has become a regular feature of town council meetings.  Instead of providing a substantive response to Abrams' questions, the mayor chastised him for not having spoken up earlier.  In fact, Abrams did raise objections at the April 12, 2014 town meeting.
