Other tasks distracted me from posting links to information for this week's meetings in a timely fashion; mea culpa!

Last night's P&Z meeting featured a review of notification requirements found in the various land use ordinances.  However, the revised schedule was not included in the December 1, 2015 packet. It was provided when the meeting commenced, but neither that document nor the meeting audio have been posted yet at the town website. 

Tonight's Town Council meeting features approval of the Findings of Fact for the denial of the hotel variance appeal as well as a closed session pertaining to Town Councilor Chuck Ring's pending litigation against the Town of Edgewood.  Draft Findings are included in the December 2, 2015 packet information.

A preliminary Council Agenda for December 2, 2015  can be viewed/downloaded at the town website. For those who are following the appeal of the variances for the motel, the agenda shows approval of the Findings of Fact. A countdown to the deadline for a possible appeal of the Council's decision begins upon approval of that document.

The Town Council agenda and packet for November 18, 2015 can be viewed/downloaded from the town website's Agenda Center.  A copy of the packet as well as documents pertaining to the appeal of the motel variance are available on Drive in the Council Packets folder.

Please note that on pp. 6-7 of the P&Z packet there is a schedule for a review, revision, and recommendation process for standardizing/amending public notice requirements for land use matters. 

• Early Neighborhood Notification Ordinance (2006-02) beginning at the December 1, 2015 meeting.  
• The Zoning Ordinance (2014-02 as Amended August 5, 2015) on January 5, 2016;
• The Sign Ordinance (2009-02) on February 2, 2016 and; 
• The Subdivision Ordinance (2014-03 as Amended February 4, 2015) on March 1, 2016. [This will also be the date of the municipal election so expect a change in the schedule for this ordinance.]

Public comment will be allowed during the first of the four steps outlined for each ordinance.

2.  Review, discussion, and revision of Staff prepared language/recommendation.
3.  Legal Review
4.  Presentation to the Council for its review/adoption.

A preliminary agenda for the November 17, 2015 Planning Commission meeting is now available for viewing/downloading at the town website.  Note the discussion item regarding changes to various ordinances which specify public notification procedures. 

Appeal of the Commission's approval of variances for # 6 and #8 Marietta Court

A copy of the appeals packet (which may not be complete) is now available for reading/downloading at the town website.  The appeal is scheduled to be heard during the November 18, 2015 town council meeting.  Although the town's Zoning Ordinance specifies that variance appeals are to be heard by the Town Council in a "de novo" public hearing, it appears that the town is trying to follow some sort of an abbreviated procedure. 

Map of the proposed infill annexation [UPDATED]

This map will be part of the town's submission to the Governor's Boundary Commission.  It will be accompanied by a list of specific parcels with legal descriptions; that document has not yet been republished.  If you are checking to see if you are part of the infill, please contact the town office. At this time, it appears that the annexation moratorium which is scheduled to be adopted later this month will prevent the annexation from being finalized until after the March 2016 municipal elections.

The Municipal Boundary Commission will hold a hearing on Friday, April 22, 2016 at 10:00 a.m. in the Edgewood Community Center to consider the Town's request to bring more land inside its boundaries.  A copy of the map showing proposed infill is available at the Town's website.

The November 4, 2015 meeting was mostly routine with the exception of public comments which begin at approximately 22 minutes. The audio file can be listened to/downloaded from the town website.  The Agenda Center link goes to an index page which has a variety of items listed in no particular order; look for the date and meeting type to find audio for a particular meeting.  At the present time, there are three different index pages; it may be necessary to search through several lists.

Study session announced by the Santa Fe Board of County Commissioners

On Friday, October 9, 2015 the Santa Fe Board of County Commissioners notified county residents that it has scheduled a special study session at 10:00 a.m. on Tuesday October 13, 2015.  The announcement of the meeting specifies that no action will be taken.  The following items are on the agenda for presentation/discussion:

Campbell Ranch update

After observing an unusual amount of traffic entering the Portal from "Campbell Ranch" and related search terms for the past several weeks, I decided to look further into what might be the cause. This is what I found:

Santa Fe Ranch and Farms (a portion of Campbell Ranch) launched a promotional website earlier this year with an accompanying press release, but it has only been in the past few weeks that the project has been noticed by the general public. There is only a rudimentary area map on the official site, but several things indicated to me that the land being offered for sale lies entirely in unincorporated Santa Fe County.

I was able to confirm my impression using a map which shows the general location and several landmarks located at a commercial real estate website called Commercial Connected. By comparing landmarks on their map with those on a draft zone map of Edgewood's official boundaries, I concluded that the land being offered for sale does appear to be located entirely within Santa Fe County, but outside of Edgewood's present boundaries. It appears likely that the two southernmost parcels (Tract 5 and Tract 6) are adjacent to the northernmost boundary of the town's lands in Santa Fe County. 

In addition, the area map at Santa Fe Ranch and Farms shows plans to add a second phase consisting of 8 similar parcels east of North 14 and south of NM 344. Two of those parcels, tentatively numbered Tract 11 and Tract 12, are shown directly to the west of Tracts 5 & 6 and immediately north of Edgewood's boundary line. 

A shared water system, with its attendant complications, would not be needed for this project as a domestic well permit for each parcel should suffice. However, the question of obtaining sufficient water rights to serve a shared system proposed for the Master Plan development which is located inside Edgewood boundaries has proved elusive, and has held up development in that portion of Campbell Ranch for more than a decade.

September 9, 2015: The Town of Edgewood Governing Body will hold a public hearing to consider proposed Ordinance 2015-07 the text of which is not yet available.  I will post the information if/when it is made available.  The informal word is that it concerns a project which is dependent upon the town's approval of the variance request on Marietta Court.

September 15, 2015 September 22, 2015: The Planning & Zoning Commission will revisit the public hearing of August 18, 2015 for the variance request on Marietta Court due to errors and omissions during the notification process for the original public hearing.

P&Z agenda and packet for August 18, 2015

The information, including the staff report regarding the requests for variances at # 6 and # 8 Marietta Court, is now available in the agenda center.  Some of the larger format documents will need to be requested for transmission via e-mail.  I have already submitted an IPRA request for three of the pages and will post links when I receive the information. The project which is the subject of the public hearing is described by the applicants as being for a proposed four story Comfort Inn & Suites consisting of 72 rooms to be built adjacent to the south side of I-40 and fronting on Marietta Court to the east of Tractor Supply.  The variances requested are for increased building height, reduced building setbacks, and increased numbers of and heights for signage.

Town meeting information:

The audio from the July 30, 2015 P&Z special meeting (12 minutes; 8 seconds) is now available at the town website. The purpose of the meeting was to issue a call for a public hearing to consider variances from the zoning and sign ordinances. Shortly after the meeting, a public notice sign was posted on a property located adjacent to the south side of I-40 east of Tractor Supply and north of Mail and Copy.

The June 17, 2015 change in Edgewood's mayor pro tem.

Following a closed session near the end of the June 17, 2015 regular council meeting, the Edgewood Town Council voted to remove Town Councilor Chuck Ring as mayor pro tem*. Mayor Brad Hill had been notified prior to that meeting that Ring had filed a notice of tort claim against the town. Upon consulting with the town attorneys, Ring was asked by the mayor to step down as mayor pro tem. Councilor John Abrams was selected to replace Ring.

[*Clarification added on 07/31/2015 after further readings of the meeting minutes; There were two votes taken subsequent to the closed session. The first called upon Ring to step down from his position as Mayor Pro Tempore. Ring voted in favor of the motion. When asked by the mayor if he then intended to step aside voluntarily, Ring declined in spite of having voted in favor of the previous motion.  The second action was a motion to appoint Councilor John Abrams as his replacement.]

[Note: The draft minutes for the meeting which were eventually approved as written can be read beginning on p. 4 of the July 15, 2015 council packet. It would appear that Ring's continuing to serve in that position would conflict with and perhaps undermine the town's response to his and other, related litigation.]
